1. Who we are

Plate: Training & Meals (“Plate”, “we”, “us” or “our”) is operated by MDC SOFTWARE LTD, registered in England and Wales under company number 17520443.

Registered office:
71–75 Shelton Street
Covent Garden

United Kingdom

Privacy and support email: maciejchmura@plate-org.com

MDC SOFTWARE LTD is the controller responsible for the personal information described in this policy.

This policy explains how we collect, use and share personal information when you use the Plate mobile application or contact us. It also explains your choices and privacy rights.

2. Information we collect

We collect information you provide directly, information created through your use of Plate and information generated to provide personalised features.

Account information

This includes your name, email address, account identifiers and information used to manage your email-and-password login.

Fitness and training information

Depending on what you provide and the features you use, this may include:

  • Age, sex, height, current weight and target weight.

  • Fitness goals, training focus, experience and reported physical ability.

  • Training limitations, including injuries or health information you enter.

  • Available equipment, training environment and preferred workout duration.

  • Availability, sports participation and important event details.

  • Generated training plans, workout performance, completion records, check-ins, feedback and plan-adjustment history.

Nutrition and meal information

This may include:

  • Calorie and macronutrient targets.

  • Allergies, dietary restrictions and food preferences.

  • Preferred cuisines, budget and cooking or meal-preparation preferences.

  • Meal plans, ingredients, shopping lists and meal feedback.

Support and operational information

We collect information you include in support messages or privacy requests. We also store generation and error records used to operate and troubleshoot Plate.

[Confirm whether operational records also contain IP addresses, device details or request contents, and add those categories if applicable.]

Plate does not currently use advertising analytics, crash-reporting tools, photo uploads, Apple Health or Health Connect integrations. Operational records described above are separate from those features.

3. Why we use your information

We use personal information to:

  • Create and manage your account.

  • Generate personalised training plans, meal plans and nutrition targets.

  • Provide food-search and shopping-list features.

  • Adjust plans using your feedback, check-ins and recorded performance.

  • Provide support and respond to privacy requests.

  • Maintain, secure and troubleshoot Plate.

  • Comply with applicable legal obligations.

We send account and service communications. We do not send promotional marketing emails.

Our legal bases

Under UK data protection law, we rely on:

  • Performance of a contract: where processing is necessary to provide the Plate services you request.

  • Legitimate interests: where necessary to maintain a secure and reliable service, investigate faults, prevent misuse and respond to general enquiries, taking account of your rights.

  • Legal obligations: where processing is necessary to comply with applicable law.

  • Consent: for processing where we specifically request your permission.

[Confirm and document these legal bases against the actual processing before publication.]

Providing optional information is your choice. If you do not provide information necessary for an account or particular feature, we may be unable to provide it.

4. Health and other sensitive information

Injuries, allergies, training limitations and some physical or nutritional information may reveal information about your health. Some dietary information may also reveal other sensitive characteristics.

This information receives additional protection under applicable data protection law.

[Before launch: implement and document the appropriate special-category processing condition. If relying on explicit consent, implement a separate consent step and withdrawal process before using the following wording:]

We ask for your explicit consent before processing sensitive health information to provide personalised features, including sharing relevant information with our AI service provider.

You may withdraw your consent by emailing maciejchmura@plate-org.com. Withdrawal does not affect processing lawfully carried out before withdrawal. We may be unable to continue features that depend on this information.

Accepting our terms or reading this policy does not, by itself, constitute explicit consent to processing health information.

5. How we use artificial intelligence

Plate uses OpenAI, accessed through Supabase Edge Functions, to generate and adjust personalised training and meal content.

For training, relevant inputs may include your physical profile, goals, training limitations, equipment, availability, sports or event information, previous plans, check-ins and recorded performance.

For meals, relevant inputs may include calorie and macronutrient targets, allergies, dietary restrictions, food preferences, budget, cooking preferences and feedback.

Names and email addresses are not deliberately included in the planning requests we have reviewed. However, free-text entries may contain personal information, and previous plan records may contain internal identifiers. We therefore do not describe these requests as anonymous.

Avoid entering unnecessary identifying details or information about other people in free-text fields.

[Confirm OpenAI’s applicable retention, model-training settings and contractual arrangements. Do not infer zero retention solely from a request using store: false.]

Plate’s personalised outputs are automated recommendations for general fitness and nutrition planning. They are not medical diagnosis, treatment or professional healthcare advice.

[Confirm whether any processing constitutes solely automated decision-making with legal or similarly significant effects. If so, add the required explanation and safeguards.]

6. Service providers and sharing

We use the following providers:

  • Supabase: account authentication, database storage, hosting and Edge Functions.

  • OpenAI: generation and adaptation of personalised training and meal content.

  • FatSecret: nutrition and food-search services. Food-search queries and food identifiers are processed through a proxy to retrieve nutrition information.

  • [Identify the FatSecret proxy hosting provider]: hosting the service that forwards food-search requests.

Providers receive information relevant to the services they perform. Their roles and responsibilities depend on the service and applicable contractual arrangements.

We may also disclose information where required by law or where necessary to establish, exercise or defend legal claims.

We do not sell or rent your personal information.

7. Where information is processed

Our Supabase project is hosted in Frankfurt, Germany.

This does not mean that all processing takes place exclusively in Germany. OpenAI, FatSecret and other infrastructure supporting their services may process information in other countries.

[Before publication: identify the applicable processing locations and international-transfer arrangements. Specify the actual safeguards used, such as applicable adequacy arrangements or approved contractual safeguards, and explain how users can obtain further information or copies by contacting us.]

8. How long we retain information

We retain personal information only for as long as needed for the purposes described in this policy, including providing your account and features, resolving support requests, maintaining security and meeting applicable legal obligations.

[Complete the retention schedule before publication:]

  • Account, profile and saved content: [period or specific deletion criteria].

  • Generation and error records: [period].

  • Support correspondence: [period].

  • OpenAI processing records: [applicable provider retention].

  • Database backups: [retention period and expiry process].

  • Legal or financial records, if applicable: [period and reason].

When information is no longer needed, we delete or anonymise it. Limited information may need to be retained to meet legal obligations or establish, exercise or defend legal claims.

9. Account deletion and subscriptions

To request deletion of your account and associated personal information, email maciejchmura@plate-org.com from your registered email address where possible.

We may ask for information reasonably necessary to verify your identity.

[Before publication: define and test the deletion process, including authentication, profile information, plans, related records, provider-held information and backups. State the actual completion timeframe and any justified exceptions.]

Cancelling a subscription and deleting an account are separate actions. Cancelling a subscription does not itself delete your account or saved information. Do not assume that an account-deletion request cancels an app-store subscription; manage subscriptions through the store where you subscribed.

[Review this section when subscription and in-app deletion features are implemented.]

10. Your privacy rights

Depending on your location and the circumstances, you may have rights to:

  • Obtain access to your personal information.

  • Correct inaccurate or incomplete information.

  • Request deletion of your information.

  • Restrict certain processing.

  • Object to processing based on legitimate interests.

  • Receive certain information in a portable format.

  • Withdraw consent where processing relies on consent.

  • Challenge certain automated decisions, where applicable.

These rights are subject to applicable conditions and exceptions.

Contact maciejchmura@plate-org.com to make a request. We normally respond to UK data protection rights requests within one month, subject to lawful extensions or exceptions. Different deadlines may apply in other jurisdictions.

You may complain to the UK Information Commissioner’s Office at ico.org.uk/make-a-complaint. You may also have the right to complain to the relevant privacy regulator where you live.

11. Users aged 16 and 17

Plate is intended for people aged 16 and over. It is not intended for children under 16.

If you believe a person under 16 has provided personal information, contact maciejchmura@plate-org.com so we can investigate and take appropriate action.

Users aged 16 or 17 can contact us directly for help understanding this policy or exercising their privacy rights.

[Before launch: implement the age restriction and assess protections for users under 18, including age-appropriate explanations, privacy settings and health-data consent. A stated minimum age alone does not establish those protections.]

12. Security

We use technical and organisational measures designed to protect personal information, including access controls and secure connections.

No internet service is completely secure. Keep your login credentials confidential and contact us if you suspect unauthorised access to your account.

13. Website privacy

This policy covers the Plate mobile application and related support communications.

[If this page also serves as the website’s privacy notice, add the actual Squarespace website data practices, including contact forms, cookies, analytics and other integrations. Otherwise provide a separate website privacy and cookie notice.]

14. Changes to this policy

We may update this policy to reflect changes in Plate, our providers or applicable requirements.

We will publish the revised policy and update its effective date. Where appropriate, we will bring significant changes to your attention before they take effect and request fresh consent where required.

Terms and Conditions for Plate: Training & Meals

Effective date: [insert publication date]

1. About us

Plate: Training & Meals (“Plate”, “we”, “us” or “our”) is operated by MDC SOFTWARE LTD, registered in England and Wales under company number 17520443.

Registered office:
71–75 Shelton Street
Covent Garden
London
WC2H 9JQ
United Kingdom

Contact email: maciejchmura@plate-org.com

These terms govern your use of the Plate mobile application and related services.

Please read them before creating an account or subscribing. If you do not agree, do not register or purchase a subscription.

2. Who can use Plate

You must be at least 16 years old to use Plate.

If you are 16 or 17, you must have permission from a parent or legal guardian where required by the law in your country. Any purchase must also comply with your app store’s age, account and payment requirements.

You must provide accurate account information and must not misrepresent your age.

3. What Plate provides

Plate offers general fitness and nutrition tools, which may include:

  • Personalised training and meal plans.

  • Calorie and macronutrient targets.

  • Food and nutrition searches.

  • Shopping lists.

  • Workout tracking, check-ins and feedback.

  • Adjustments to plans based on information you provide.

The features included in a subscription will be described before purchase.

Plate uses automated systems and artificial intelligence to generate some recommendations and content.

4. Fitness, nutrition and health information

Plate provides general fitness and nutrition information. It is not a medical service and does not provide medical diagnosis, treatment or individual advice from a qualified healthcare professional.

Speak to an appropriately qualified professional before starting or substantially changing an exercise or nutrition programme if you have an injury, medical condition, eating disorder, are pregnant or breastfeeding, or have other concerns about whether a programme is suitable for you.

For users aged 16 or 17, adult calorie, weight-loss and training recommendations may be inappropriate. Seek suitable professional guidance before following a restrictive diet or significant weight-change programme.

Use exercise equipment safely and follow relevant instructions. Stop exercising if you experience pain, dizziness or other concerning symptoms, and seek appropriate medical assistance.

These statements do not limit our responsibility to provide Plate with reasonable care and skill or affect your legal rights.

5. AI-generated content and food information

AI-generated plans and recommendations can contain mistakes or unsuitable suggestions. Their usefulness depends partly on the accuracy and completeness of the information you provide.

Review recommendations before following them. Contact us if you identify a potentially unsafe or incorrect recommendation.

Nutrition information, portion sizes and calorie estimates may be approximate. Food products and ingredients can change.

If you have an allergy or intolerance, check current product labels and preparation information. Do not rely solely on Plate, an AI-generated meal plan or a food-database entry to establish whether a food is safe.

We do not guarantee a particular fitness, weight, nutritional or performance outcome. This does not remove any rights you have if the service is faulty or does not match its description.

6. Your account

You are responsible for keeping your login credentials secure and taking reasonable steps to prevent unauthorised use.

Do not share your account or use someone else’s account without permission.

Contact maciejchmura@plate-org.com if you suspect your account has been compromised.

Keep information used to generate your plans reasonably accurate and up to date, particularly information about allergies, injuries and limitations.

7. Subscriptions and free trials

Monthly subscription

The planned UK subscription price is £12.99 per month.

For other countries, the price, currency and applicable taxes will be shown before purchase. The amount displayed in the app store’s purchase confirmation is the amount you agree to pay.

Your subscription renews automatically each month unless cancelled.

Free trial

Eligible new subscribers may receive a 14-day free trial, as shown on the subscription screen and app-store purchase confirmation.

The trial starts when you confirm the subscription, rather than when you download the app.

Unless you cancel within the applicable deadline, the trial converts automatically to a paid monthly subscription at the price disclosed before you subscribed.

Trial eligibility is determined by the offer and the relevant app store. Downloading or reinstalling Plate does not guarantee another trial.

Payments

Subscriptions purchased through Apple’s App Store or Google Play are billed through the relevant store account and are subject to its applicable payment terms.

We do not receive your full payment-card details from those stores.

[Before publication: confirm the subscription is configured as 14 days free followed by £12.99/month in the UK, and remove “planned” once available.]

8. Cancelling your subscription

You can turn off automatic renewal through the store where you subscribed:

  • Apple: open your device’s Settings, select your Apple Account, then Subscriptions → Plate.

  • Google Play: open Google Play, select your profile, then Payments and subscriptions → Subscriptions → Plate.

Follow the cancellation deadline shown by your store. For an Apple free trial, cancel at least 24 hours before it ends to avoid being charged.

After cancellation, the store will show when your access ends. Paid access will ordinarily continue until the end of the current paid period. Free-trial access may end earlier under the relevant store’s rules.

Uninstalling Plate, stopping use of the app or requesting account deletion does not itself cancel an app-store subscription.

If you cannot find or cancel your subscription, contact the relevant store or email us for assistance.

9. Refunds and statutory cancellation rights

For purchases billed through Apple or Google Play, use the relevant store’s refund process. You may also contact us about a problem with Plate.

Your eligibility for a refund depends on applicable law, the circumstances and the relevant store’s policies.

Nothing in these terms excludes statutory cancellation, withdrawal or refund rights. Where applicable, the purchase process will explain any request to begin supplying digital content or services immediately and any effect this has on withdrawal rights.

We do not apply a blanket “no refunds” rule. If Plate is faulty, materially misdescribed or not supplied with reasonable care and skill, you may be entitled to a remedy under applicable consumer law.

10. Changes to prices and subscriptions

We will communicate subscription price changes in advance through the applicable store process and any additional notices required by law.

Where your consent is required, the change will not take effect without it.

You can cancel before a new price takes effect. We will not retrospectively change the price for a period you have already paid for.

11. Acceptable use

You must not:

  • Use Plate unlawfully or to harm others.

  • Attempt to access another user’s account or information.

  • Disrupt, attack or bypass the security of Plate.

  • Upload malicious code or deliberately interfere with the service.

  • Submit information about another person without appropriate authority.

  • Copy, resell or commercially exploit Plate’s software or services without permission.

  • Reverse engineer the app except where applicable law permits it.

These restrictions do not prevent you from exercising rights that cannot lawfully be restricted.

12. Your content and our intellectual property

You retain any rights you hold in information and content you submit.

You give us permission to process, store and transmit that content as necessary to provide Plate and generate the features you request, as explained in our Privacy Policy. This is not permission to use your health information for unrelated advertising.

The app’s software, branding, design and other protected materials belong to us or our licensors.

We grant you a personal, non-exclusive right to use Plate for its intended purpose while you comply with these terms and any applicable subscription requirements.

You may use generated plans for your personal training and meal planning. AI-generated content may not be unique, and we do not promise exclusive intellectual-property rights in it.

13. Privacy

Our Privacy Policy explains how we handle personal information.

Agreeing to these terms does not itself constitute explicit consent to processing sensitive health information. Where consent is required, it must be requested separately.

14. Availability, maintenance and changes

We will provide Plate with reasonable care and skill.

Temporary interruptions may occur because of maintenance, technical faults or circumstances outside our reasonable control. We will take reasonable steps to minimise disruption and restore the service.

We may update Plate to improve functionality, address security issues, comply with law or respond to changes in supporting services.

If a change would materially reduce a paid service, we will give reasonable advance notice where practicable and explain your options. These may include cancellation and an appropriate refund for an unused paid period where required.

We will not use this section to remove your statutory rights or make unfair changes to an existing subscription.

15. Suspension and termination

We may restrict or suspend access where reasonably necessary to address a serious breach of these terms, unlawful use, a security risk or a legal requirement.

Where appropriate, we will explain the reason and give you an opportunity to resolve the issue. We may act immediately where necessary to prevent harm or comply with law.

Any restriction will be proportionate to the circumstances. We will not automatically treat all payments as forfeited.

If we permanently discontinue a paid service, we will provide reasonable notice where practicable and any refund or other remedy required for the unused paid period.

You may stop using Plate at any time and request account deletion by emailing maciejchmura@plate-org.com. Cancel any subscription separately through the relevant store.

16. Our responsibility to you

We are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We do not exclude or limit liability for:

  • Death or personal injury caused by our negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of consumer rights that cannot lawfully be excluded.

  • Any other liability that cannot lawfully be excluded or limited.

Plate is supplied for personal use. We are not responsible for business losses arising from its use for commercial purposes.

You remain responsible for your own actions, but this does not excuse us from responsibility for a faulty or negligently provided service.

17. App-store terms

Your use of Apple’s App Store or Google Play is also governed by the relevant store’s terms.

These terms govern our relationship with you concerning Plate. They do not replace store purchase conditions or reduce any mandatory protections you have.

For iOS, Apple’s standard end-user licence agreement applies where applicable unless a valid custom licence is supplied through the App Store.

18. Changes to these terms

We may revise these terms for legitimate reasons, such as changes to Plate, legal requirements, security or the way the service operates.

We will give reasonable notice of material changes before they take effect, unless urgent legal or security reasons prevent this.

Changes will not apply retrospectively to resolve an existing dispute or remove rights you have already acquired. Where a change materially disadvantages you, we will explain your cancellation options and any applicable refund rights.

19. Complaints and disputes

Please contact maciejchmura@plate-org.com if you have a complaint. Include enough information for us to investigate, but do not send passwords or full payment-card details.

These terms are governed by the law of England and Wales. However, if you are a consumer living elsewhere, this does not deprive you of mandatory protections provided by the law applicable where you live.

You may bring proceedings in the courts available to you under applicable consumer law. These terms do not require every consumer to bring a claim exclusively in England and Wales.
